DataQ Challenges
A DataQ challenge is the formal process for disputing inaccurate or incorrect data in FMCSA's Motor Carrier Management Information System (MCMIS). If you believe a roadside inspection, crash report, or citation was entered incorrectly, you can file a DataQ challenge through the FMCSA website. CDL Consultants handles the entire process — from gathering evidence to submitting and following up on your challenge — to maximize your chance of getting violations removed.
FMCSA typically has 30 days to respond to a DataQ challenge, though complex cases can take 60-90 days. Our team tracks every challenge aggressively and follows up to prevent delays. Most of our DataQ challenges are resolved within 30-45 days.
DataQ can address inaccurate roadside inspection data including violations that were entered incorrectly, violations that don't match the actual inspection report, crashes where you weren't the driver, HOS violations proven incorrect by ELD data, and violations entered in the wrong BASIC category. However, DataQ cannot remove valid, accurately-entered violations — it's specifically for correcting errors in the FMCSA data system.
CSA Scores
CSA (Compliance, Safety, Accountability) is FMCSA's safety measurement system that tracks carrier and driver safety performance across 7 BASICs: Unsafe Driving, Hours-of-Service Compliance, Driver Fitness, Controlled Substances/Alcohol, Vehicle Maintenance, Hazardous Materials Compliance, and Crash Indicator. High scores can trigger FMCSA intervention, make it harder to get hired by carriers, and increase insurance costs. Scores above certain thresholds put you on FMCSA's radar for increased inspections and investigations.
Yes. CSA scores can be reduced through a combination of DataQ challenges (removing inaccurate violations), time (violations age out after 2-3 years), and compliance improvement. Our team analyzes every violation contributing to your score, identifies which ones are challengeable, and builds a strategy to bring your score below the intervention threshold as quickly as possible.
Ticket Defense
CDL holders are held to a much higher standard than regular drivers. Many violations that are minor for regular drivers are classified as "serious violations" for CDL holders and can result in disqualification. For example, speeding 15+ MPH over the limit in a CMV is a serious violation. Two serious violations in 3 years = 60-day disqualification. Three = 120-day disqualification. The stakes are much higher, which is why professional defense matters.
Yes. CDL Consultants has a network of licensed traffic defense attorneys in all 50 states. No matter where the citation was issued, we can represent you or connect you with qualified local counsel who specializes in CDL defense.
Almost never. Paying a ticket is an admission of guilt and the violation goes on your CDL record permanently (or for several years depending on severity). Even if the ticket amount seems small, the impact on your CSA score, your PSP report, and your employability can cost you tens of thousands of dollars over your career. Always consult with us before paying any CDL violation.
